PRICES, RESERVATIONS & PAYMENT
PTL guarantees that our published trip prices will not change at least a substantial increase will be launched by the local suppliers. We charge a single supplement to individual travelers who wish to ensure that they have private rooms throughout a trip. Our prices are in U.S. dollars and include all taxes accordingly by law.

To reserve your trip, we require a deposit of US$500 per person. The balance of your payment is due 90 days prior to departure. To confirm your reservation, you must complete, sign and return a Traveler information Form, and an Acknowledgement of Risk, Release and Indemnity 14 days of receipt of your confirmation package.

CANCELLING/SWITCHING TRIPS
If you must cancel your reservation, the cancellation fees are as follows:

0–30   days              100% of trip price

Over 60 days prior to your original departure date, you may transfer to a different trip in the same calendar year upon payment of a fee of US$100 per person. If you cancel this subsequent reservation then the cancellation fees applicable shall be the higher of the cancellation fee on your original reservation or the cancellation fee on the trip to which you transferred. Within 60 days of departure no changes can be made and the cancellation fees will apply.

PTL GALAPAGOS & PATAGONIA
The payment and cancellation terms for our By Sea trips differ from those outlined above. We will reconfirm the terms and conditions for those trips before you book any of those trips.

CANCELLATION INSURANCE
We strongly recommend Peru Travel & Leisure ‘s cancellation insurance. A summary of the Plan is included with your confirmation package and can be found here. The price of the insurance is automatically added to each reservation and will appear on your invoice. Once you get the invoice you will have the chance to accept or decline this item.

CANCELLATION BY PTL

PTL reserves the right to cancel any Group Holiday at any time for any reason if there are too few participants, or if quality of the trip or the safety of travelers is judged to be compromised. In such a case, refund of payments received by PTL shall constitute full settlement. PTL cannot assume responsibility for any loss incurred on account of non-refundable air tickets.

ELIGIBILITY
We require that travelers be at least 18 years of age on all trips except for With the Kids trips, which are variously designated for children aged 15 and older (15+), 12 and older (12+), 8 and older (8+), and all ages from infancy (0+).

PREPARING FOR YOUR TRIP
Our trips entail risks – and rewards – beyond those encountered at home. We always stress that our trips are a partnership with travelers. Our primary objective is to take the hassle out of a great travel experience. In return, we count on people to ensure they are healthy and fit; to read our pre-trip materials about clothing, training, medical requirements and culture-specific etiquette; to appreciate that in some countries, local living standards, practices, services and accommodations may differ from those in North America or Europe (often in delightful ways); and to understand – indeed relish – the fact that a road less travelled means a more unpredictable and more rewarding adventure.

TRAVEL DOCUMENTS AND PASSPORT
The Visa and Passport requirements of countries to which we travel vary by nationality and change for reasons beyond our control. Although we endeavour to provide you with accurate information about these requirements it remains the responsibility of each traveler to verify that they have the appropriate travel documents. PTL cannot be liable for any expenses or costs arising from a traveler being prohibited from entering a country we visit on trip

EXTERNAL TRAVEL SERVICES
PTL may recommend the services of external travel agencies or other support services in response to requests made by travelers for services outside of the scope of the PTL trip. Although we endeavour to recommend only companies that provide the highest levels of service and work closely with them to try and obtain special treatment for PTL travelers, we cannot guarantee the services provided by these third party service providers. PTL cannot be liable for any expenses or costs arising from any services, or lack thereof, provided by any external travel service company.

HEALTH
By sending a deposit toward your trip purchase and returning your Traveler Information Form, you certify that you do not have any physical condition or disability that would create a hazard for you or other travelers and you have received all appropriate vaccinations. Please consult your doctor.

INSURANCE
Before travelling on a trip, PTL strongly recommends that you review your personal insurance and your health insurance to ensure you have coverage appropriate to meet your needs, and the needs of your family and dependants, in case of any loss of property, or accident, injury or death.

RISKS
All PTL trips are intentionally designed to take clients “off the beaten path” to places where facilities, infrastructure, and safety and other standards may not be sophisticated and may be different from those in a traveler’s home country. Trips involve physical activity that can be demanding, depending on the condition of the traveler, and the risk of serious personal injury, including permanent disability and death from accident, illness or the actions or negligence of other persons. Medical facilities and services may not be easily accessible and may not be sophisticated. There are other risks associated with the trips, such as theft or loss of or damage to property. Some of the services provided in connection with the trip, including lodging, transportation, food service, and local tours and activities, are obtained from independent suppliers over whom Peru Travel & Leisure has no control.

LIMITATION OF LIABILITY, RELEASE AND INDEMNITY
To be eligible to take a PTL trip, travelers must accept these risks and assume full responsibility for any loss, injury, death or damage to them, their family or their dependants arising in connection with their participation, or the participation of their family, in the trips. Travelers must have their own insurance appropriate to their needs and the needs of their family or dependants in respect of such loss, injury, death or damage.

Although Peru Travel & Leisure endeavours to choose appropriate independent suppliers to provide services on the trips, Peru Travel & Leisure has no right to control their operations and therefore makes travel arrangements for the trips on the condition that Peru Travel & Leisure will not be liable for any act or omission of any independent supplier or any unrelated third party. The services provided by independent suppliers are subject to the laws of the place where the services are provided, and any conditions imposed by those suppliers. The liability of the independent suppliers may be limited by their tariffs, conditions of carriage, tickets and vouchers, and international conventions and agreements.

The cost of all PTL trips is based on travelers agreeing to this Limitation of Liability, Release and Indemnity. In consideration for participating in the trips, travelers agree not to sue Peru Travel & Leisure in respect of, and forever release them from, all liability for economic loss and physical or mental injury, direct or indirect, arising in connection with the trip – including, without limitation, permanent disability and death; any emotional distress; any loss of services, financial support, aid, consortium or companionship; and any damage to or loss of property – in each case even if caused in whole or in part by the conduct, including the negligence, of Peru Travel & Leisure, except where such loss, injury or damage is caused by reckless or fraudulent conduct on the part of PTL or their employees, guides, shareholders, officers or directors, in which case the traveler retains the right to sue only PTL in respect of that conduct.

Travelers further agree that they will indemnify and hold Peru Travel & Leisure harmless in respect of any claims arising in connection with the trip made by: i) third parties, which arise from the misconduct of the travelers; ii) the traveler’s family members, dependants or heirs, iii) third parties, which the traveler, their estate, their family members, dependants or heirs have sued, if damages are recovered from such third parties, to the extent the third party obtains any indemnification from Peru Travel & Leisure; except where the loss, injury, death or damage is caused by the reckless or fraudulent conduct on the part of PTL, or their employees, guides, shareholders, officers or directors.

PTL reserves the right to decline accepting or retaining any traveler whose health or actions in Peru Travel & Leisure’s sole judgment impede the operation of a trip or the welfare or enjoyment of fellow travelers. In further consideration for participating in the trip, travelers agree that PTL, or their designate, may use any photographic or film records of the trips for promotional and/or commercial purposes, without any remuneration to the traveler. The traveler agrees to assign all right, title and interest they may have in or to any media in which their name or likeness might be used to PTL.

Travelers agree that Peru Travel & Leisure Inc. is the trustee of the respective rights of Peru Travel & Leisure under this Limitation of Liability, Release and Indemnity, which will apply to a traveller’s trips with PTL, and any transfer of a reservation to another trip, including any pre-trip or post-trip extensions. This Limitation of Liability, Release and Indemnity is binding upon all members of the traveler’s family, dependants, estate, heirs, successors and legal personal representatives. Any claim or dispute arising out of or relating to this Limitation of Liability, Release and Indemnity or its interpretation, the trip, or the traveler’s relationship with Peru Travel & Leisure will be resolved exclusively in the courts of Lima and will be governed exclusively by Peru law.
